These terms explain how Past Forward Convert handles quotes, customer authorization, fragile media, optional enhancement, delivery, original-media pickup, digital files, and customer responsibilities.

Past Forward Convert provides media digitization, transfer, scanning, optional AI-assisted enhancement, file delivery, USB delivery, optional DVD creation, and related family memory preservation services.
The exact services, quantities, formats, delivery method, pricing, and project expectations are the services listed in the accepted quote, invoice, order confirmation, or written project approval.
By submitting media or approving a project, the customer represents that they own the submitted media or have permission to authorize the requested work.
The customer confirms that they have permission to reproduce the content and are not knowingly submitting illegal or infringing material.
The customer gives Past Forward Convert the limited permission needed to inspect, play, copy, process, enhance, temporarily store, and deliver the media for the requested service. Ownership of the customer's content remains with the customer.
Older tapes, film, photographs, slides, negatives, audio media, storage devices, cases, reels, and labels may already contain visible or hidden deterioration before Past Forward Convert receives them.
Condition issues may include brittleness, mold, adhesion, oxide shedding, creases, breaks, splices, warping, water or heat damage, corrosion, contamination, tracking problems, signal loss, dropouts, audio loss, color fading, playback incompatibility, damaged cases, deteriorated labels, or damage caused by prior storage or prior playback.
Some problems are not detectable until ordinary inspection, cleaning, rewinding, playback, transfer, or processing begins.
Past Forward Convert will use reasonable care when handling customer media.
Old, fragile, previously damaged, contaminated, or deteriorated media can fail during ordinary inspection, cleaning, rewinding, playback, transfer, transport, or processing even when reasonable care is used.
Successful playback or digitization cannot be guaranteed. Some media may be partially recoverable, completely unrecoverable, or unsafe to process.
Past Forward Convert may stop work when continued processing could create additional risk, and may contact the customer for approval before optional repair, cleaning, restoration, or extraordinary work.
Not every recording can be recovered. Results depend on the original media, recording equipment, storage conditions, age, format, prior damage, and the quality of the original recording.
A completed transfer may contain defects already present in the source media, including picture noise, tracking issues, distortion, missing footage, audio problems, color fading, dropouts, or blank sections.
Charges for inspection, preparation, cleaning, attempted recovery, media, shipping, or approved labor may still apply when disclosed in the quote or order terms.
Premium Video Enhancement is optional. Customers may choose standard digitization without enhancement.
Enhancement may use AI-assisted and conventional restoration tools such as deinterlacing, noise reduction, stabilization, color adjustment, sharpening, upscaling, compression cleanup, or frame processing where appropriate.
Results vary by source. Enhancement cannot reliably recreate detail that was never captured, and enhanced output may look different from the original.
Enhanced files are intended to create a cleaner viewing copy when possible. They are not guaranteed to look like modern 4K, 8K, professional cinema, or perfect archival restoration.
When enhancement is selected, Past Forward Convert recommends keeping the original digitized files and enhanced files separately.
Initial quotes may be based on customer descriptions, rough counts, photographs, labels, or other information supplied before the media is physically reviewed.
Final pricing can change if the quantity, running time, format, condition, repair requirements, requested outputs, storage needs, shipping needs, or project scope differs from the original information.
Material price changes require customer approval before proceeding. Rush work, special handling, replacement media, shipping, and extraordinary restoration require prior disclosure.
Quote expiration periods and financial details should be confirmed in the written quote or invoice.
Turnaround estimates are estimates, not guarantees.
Timing may be affected by media condition, quantity, equipment issues, customer response delays, special processing, shipping, file-upload times, cloud-processing times, or unforeseen technical problems.
Customers should review delivered files promptly and report missing files, incorrect names, obvious transfer errors, or delivery issues within the review period stated in the quote, invoice, or order communication.
Corrections to Past Forward Convert's work are different from new requests, re-editing, enhancement changes, or problems originating in the source media.
Past Forward Convert does not promise indefinite free revisions.
Past Forward Convert will notify the customer when the project and original media are ready for pickup, return shipment, or another agreed delivery method.
Unless a different written arrangement has been approved, customers must retrieve or arrange return of their original tapes, film, photographs, slides, negatives, audio media, storage devices, and other physical property within 90 calendar days after the first written completion or pickup notice.
Past Forward Convert will make reasonable efforts to contact the customer using the contact information provided with the order. If the original media remains unclaimed after the 90-day period, and the required reminder notices have been sent, the media may be considered abandoned under the customer's agreement with Past Forward Convert and may become eligible for permanent destruction or secure disposal.
Destruction is irreversible. Once original media has been destroyed, it cannot be returned or recovered.
Customers are responsible for maintaining accurate email, telephone, mailing, and shipping information. Failure to receive a notice because of outdated, incomplete, filtered, or incorrect contact information does not automatically extend the retention period, subject to applicable law.
Past Forward Convert may approve a longer retention period in writing before the deadline. Storage fees may apply only when disclosed and approved in advance.
Original media is not destroyed automatically on day 91. It becomes eligible for owner review only after the 90-day period and required notice process are complete.
Destroying or securely disposing of unclaimed original physical media after the applicable 90-day period does not, by itself, remove the customer's completed digital files from the Past Forward Convert Google Drive delivery folder.
Past Forward Convert currently intends to keep completed customer digital files available through Google Drive on an ongoing basis so customers can continue accessing, downloading, and sharing their files.
Customers are strongly encouraged to download their files promptly and maintain at least one independent backup. Google Drive access depends on third-party technology, internet availability, account status, platform policies, storage capacity, security, and other circumstances that may be outside Past Forward Convert's control.
Past Forward Convert cannot guarantee uninterrupted or perpetual access under every possible circumstance.
Past Forward Convert will not intentionally remove completed digital files solely because the customer did not retrieve the original physical media within the 90-day period, unless removal is required by law, requested by the customer, necessary for security or privacy reasons, or required because continuing storage becomes technically or commercially unavailable.
When reasonably possible, Past Forward Convert will provide advance notice before any planned discontinuation of ongoing digital-file access.
Mail-in customers should request a quote and wait for shipping instructions before sending original media.
The customer is responsible for secure packaging and accurate shipment information. Carrier loss or damage is subject to carrier terms and available insurance.
Past Forward Convert should document receipt and return shipment when media is mailed or shipped.
Payment details, deposits, final payment timing, accepted payment methods, refunds, cancellations, custom USB drives, DVDs, shipping, repair, and completed labor should be confirmed in the accepted quote, invoice, or written project approval.
Past Forward Convert should not charge or authorize undisclosed fees automatically. Nonrefundable expenses or completed labor should be disclosed before the customer approves the work.
Customer media is treated as private and used only to complete the requested work, except when the customer authorizes use, disclosure is legally required, or a necessary service provider processes data under the business workflow.
Past Forward Convert will not use customer media in marketing, demonstrations, AI training, before-and-after examples, or social media without separate written permission.
This section is a draft for attorney review. To the extent permitted by law, recoverable damages may be limited to an appropriate defined amount, such as amounts paid for the affected service, but the final wording and any limits must be reviewed by a Wisconsin-licensed attorney.
Nothing in these terms is intended to excuse intentional misconduct, gross negligence, or rights that cannot legally be waived.
